– LD 319, SP 140 – An Act to Amend Maine’s Underground Oil Storage Tank Laws

Under current law, upon the expiration date of a manufacturer’s warranty for certain underground oil storage tanks, the tank and its associated piping must be removed from service and properly abandoned, except that a double-walled underground oil storage tank may continue in service up to 10 years beyond the expiration of the warranty if certain testing is conducted to verify the integrity of the tank. This bill removes the 10-year limitation, thereby allowing such double-walled tanks to continue in service indefinitely as long as the same testing requirements are satisfied.
